User Agreement

This Agreement (“Agreement”) begins on the date of acceptance by Coach and Client and lasts until termination of the Coaching by either party.

1) Services

The services to be provided by the coach for the customer are usually online coaching services. The Client will initiate the session at the agreed time by contacting the Coach via online media (FaceTime, Zoom or Skype™ as discussed; Coach Skype™ ID: Travelcaptain). The coach also offers outdoor coaching. A coaching session lasts up to 60 minutes. A longer duration of the session is at the discretion of the coach.

Coaching can address specific personal projects, business successes or framework conditions in the life or work of the client. Other coaching offers include value clarification, brainstorming, showing action plans, examining ways of acting in life, asking clarifying questions and expressing wishes or suggestions for action.

The coach conducts direct and personal discussions throughout the working relationship. The client understands that successful coaching requires a co-active collaborative approach between client and coach. In the coaching relationship, the coach plays the role of facilitator of change, but it is the client’s responsibility to make or effect the change. This responsibility includes the client showing up for each scheduled coaching session and completing any action items the client has promised between sessions. In addition, you acknowledge that each individual’s results of success may vary and depend on factors such as drive, commitment and motivation. In other words, we do not guarantee results, you are responsible for your own success and, as with any business, there is a risk of losing money.

Trial session

A one-off trial session can be taken at a reduced price, after which there is the opportunity to agree on a coach-customer relationship geared towards mid and long-term success.

2) Fees

The fees for the initial consultation, for individual sessions and for flat rates are displayed in the booking link for each appointment type. Fees are paid in advance (or by separate agreement). If there is a separate agreement (e.g. separate agreement with the employer) or if the session is part of a package, the booking link will show a zero fee.

3) Pro bono (free) coaching

In the case of pro bono (free) coaching, the coach can terminate the business relationship at any time with immediate effect, for example after repeated delays or non-completion of tasks by the customer.

4) Cancellation and no-shows

A 24-hour cancellation policy is observed. Similar to a doctor’s or dentist’s office, if a client reschedule their appointment more than 24 hours in advance, everything goes as usual. If the rescheduling is scheduled less than 24 hours in advance or the client completely forgets a session, the session is considered completed and counts towards the coaching plan.

If the client does not start their session within 10 minutes after the agreed time or shows up later than 10 minutes after the agreed time, the session will be canceled by the coach and the appointment will unfortunately have to be billed. An email notification system is available for cancellations and rebookings. Sessions are booked and paid for in advance.

5) Time intervals between sessions

Coaching sessions usually take place online via FaceTime, Zoom, Skype or comparable services. For consistency and continued success, sessions will not be much more than two weeks apart. Two sessions must take place within 30 days. Make sure you start your session at the agreed time to get the most out of your coaching. If you are late for your appointment, your session will still end at the originally scheduled time and will count towards your coaching plan.

6) Preparation of a meeting

To support the coaching process, you create a document provided by the coach, which you forward to the coach online 48 to 24 hours before the session. If the coach has not received this document 24 hours before the session, that session will be canceled and you will book a new appointment that will follow within 5 business days of the canceled appointment. Unfortunately, if this is not done, or if the session preparation document is not provided again 48-24 hours before the next session, the session will have to be canceled and counted towards your coaching plan.

Before a trial session, answer a few questions from the coach instead when booking the appointment.

7) Confidentiality

The coach will work within the professional ethics and guidelines established by the International Coaching Federation (see www.coachfederation.org). Copies of the ethical guidelines are available on the website. All information relating to the coach/client relationship will be kept strictly confidential, except in very rare cases where required by law, when the information disclosed involves the disclosure of illegal, unethical or criminal activity; for example, if a court might issue a subpoena. If you would like me, as your coach, to speak to someone outside of our interactions, then you must give me written permission (original letter, fax or email with signed PDF instructions) to do so.

It is also important to note that in some situations it is important to be aware of the use of technology as some customers are at risk when using certain media such as internet, mobile and cordless phones. If you use these to communicate with me, I will assume that this continues to be appropriate in my interactions with you.

8) History

The customer undertakes to disclose details of past or current psychological or psychiatric treatment. Coaching and therapy are not the same. Coaching is not therapy and the client will not undertake any therapy as part of the coaching program. We define therapy as coming to terms with the past. Our focus in your coaching is to achieve results both in the present and in the future.

By entering into the coaching relationship and accepting this Agreement, you agree that if you experience any mental health issues during the coaching relationship, you will notify me immediately so that I can discuss with you an appropriate referral to a specialist.

9) Privacy

At any point in the coaching session, the client can state their preference not to discuss a particular topic by simply stating that they would rather not discuss that topic. The coach agrees to respect this boundary and will not attempt to direct the conversation in that direction.

10) Cancellation and Refund

Failure to comply with the guidelines agreed above may result in the coach terminating the business relationship with reimbursement for the sessions not used in the future according to the price scale. Likewise, if the customer is not satisfied with the process or encounters a lack of results, the customer can terminate the business relationship in accordance with the aforementioned repayment rules. In all other cases, the coach and client agree to inform each other and terminate with a notice period of two weeks if they wish to end the coaching. Otherwise, the coaching will continue for the duration of the contractually agreed period.

Since coaching services are paid for in advance, the remaining sessions shown at the time of the agreed termination will be refunded accordingly without further inquiry. If a coaching package has been booked but not fully consumed, the sessions used will be offset against the single session price and the remainder will be refunded. The credit is made to an account to be named by the customer or paid out in cash. Any financial transaction costs (bank charges) incurred shall be borne by the customer.

11) Limitation of Liability

The client undertakes to hold the coach harmless from any liability and responsibility for undesirable reactions due to advice given in the coaching sessions. In no event will gregorschneidercoach.com be liable to you or any related party for any damages, including damages for loss of business profits or other pecuniary loss, whether in contract, warranty, tort (including negligence). product liability or otherwise, even if the customer has been advised of the possibility of such damages. Restrictions described herein apply to the maximum extent enforceable under applicable law.

Customer shall, at its own expense, indemnify its agents and employees against any and all claims, suits, liabilities, injuries, damages, losses, awards, costs and expenses, including attorneys’ fees, arising out of or related to use of the Program(s) under this Agreement surrendered, free. If the client feels the coaching is not working as desired, the client will communicate and take prompt action to restore the coaching relationship.

12) Miscellaneous

Non-transferability: The rights and obligations under this Agreement are personal to you. You may not assign or transfer any rights or obligations under this Agreement.

Integration: This Agreement, together with any additional terms or policies incorporated herein by reference, constitutes the entire agreement between you and gregorschneidercoach.com with respect to the Program, and this Agreement supersedes any prior proposal, representation or understanding, that you may have met in relation to the program, whether oral or written.

Terms of Service

The customer agrees to the general terms and conditions of Coach, which are available on the website https://gregorschneidercoach.com.

Jurisdiction and Choice of Law Clause

This contract is subject to, interpreted and enforced under the laws of the Federal Republic of Germany; The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
